If all the documents are available and the buyer has also checked the authenticity of these documents, then the next step is to arrange the Sale and Purchase Deed. Here are the steps that you will generally do when taking care of AJB.
1. Visit the PPAT Office (Land Deed Making Official)
Since the Deed of Sale and Purchase was made by the Official for Making Land Deeds or PPAT, the first thing you have to do is visit the PPAT office itself. The PPAT office that you visit is in accordance with the area where the land being traded is located. If there is no PPAT office in that area, then you can visit the sub-district office.
Make sure that when you visit the PPAT office you bring all the documents that have been prepared in advance. In addition, at the time of making AJB, related parties must also be present, such as a buyer, seller, and two witnesses who come from sub-district officials or notary employees. If there is a party that is absent, it must be accompanied by a power of attorney.
2. Checking Documents by PPAT (Land Deed Making Official)
After submitting all the required documents, the PPAT will conduct a check which usually takes several days. This checking stage is carried out to ensure the authenticity of special documents to check whether the land or building is not in dispute status.
3. The process of signing the sale and purchase deed
If it has entered the stage of signing the Sale and Purchase Deed, it means that all documents are valid and all costs related to the buying and selling process and making the deed have been paid off. As previously stated, during this process all parties concerned must be present, including two witnesses.
In this process, the PPAT will describe in detail the contents of the AJB and after it has been approved by all related parties, the AJB will be created immediately. AJB itself will later consist of two original sheets which will be kept by the PPAT and submitted to the Defense Office. Sellers and buyers will also receive a copy of the AJB.
4. Name Transfer Process
When the Sale and Purchase Deed has been drawn up and signed, the ownership of the land or building has officially transferred to the buyer. So there needs to be further activities to reverse the owner’s name on the land certificate from the old owner or seller to the new owner or buyer.
PPAT will submit the original AJB, Application for Transfer of Name, Land Certificate, Land and Building Tax Payment, Photocopy of Buyer and Selling KTP, and BPHTB to the defense office. Later the buyer will get a proof in which the name of the old owner is crossed out on the certificate in black ink and initialed.
