Two Wisconsin girls repeatedly stab a classmate.
One of the two actors has a motive if he believes the fictional horror character Slender Man will attack his family.
If he doesn’t kill his friend.
Morgan Geyser was 12 years old at the time of the 2014 attack, a survivor of Payton Leutner.
Geyser’s attorney, Matthew Pinix, argued that he should have been charged with attempted second-degree deliberate murder.
Furthermore, the attack will put the case in juvenile court.
Instead, he was charged with attempted first-degree deliberate murder.
But the Wisconsin Second District Court of Appeals found that the Waukesha County Court kept the case in adult court.
By saying that the probable cause was found that he had attempted first-degree deliberate murder.
Pinix said he plans to appeal Wednesday’s ruling to the Wisconsin Supreme Court.
Morgan’s fight isn’t over yet, said Pinix.
“The appeals court avoided serious problems in this case and did struggle with several areas of the law.”
Waukesha District Attorney Susan Opper, who is demanding the case, did not want to comment.
Geyser pleaded guilty to attempted first-degree deliberate murder.
Geyser and co-defendant Anissa Weier lured Payton Leutner from the inn to a nearby wooded park on the Milwaukee suburb of Waukesha.
Geyser stabbed Leutner 19 times, as Weier pushed him away, leaving the girl for dead.
The three girls were 12 years old at the time.
Leutner recalled in a 2019 interview with ABC News how, prior to the stabbing, Weier told him to lie on the ground and cover himself with sticks and leaves.
As part of what Leutner believes to be a game of hiding and seek.
After the stabbing, Leutner said he finally got up, picked up a tree, and walked to the road where a cyclist found him and asked for help.
Geyser was ordered to spend 40 years in a mental health institution because he was the mastermind and carried out the stabbing, prosecutors said.
Weier has been committed to mental health facilities for 25 years.
Geyser’s attorneys argued on the appeal that Geyser could not really understand what rights he was giving up when he agreed to speak alone to a detective while he was in custody and admitted to having committed a stabbing.
The appeals court said there was no need to decide whether a lower court was wrong in making these comments to the police.
This case attracted widespread attention partly because of the girls’ affinity for the Slender Man character.
Slender Man was created online by Eric Knudson in 2009 as a mysterious ghost that is edited into everyday pictures of children playing.
He is usually depicted as a lanky and lanky figure in a black suit with a white face without any features. She has grown into a popular ghost and has appeared in video games, online stories and 2018 films.
